Terms and Conditions for Private and Online Tutoring.

This document outlines the expectations and responsibilities of all parties involved in private and online tutoring and provides clear guidelines to ensure a positive and productive tutoring experience.

Definitions.

  1. Tutor: Refers to the individual providing the tutoring services.
  2. Student: Refers to the individual receiving the tutoring services.
  3. Client: Refers to the parent/guardian of the student if the student is a minor.
  4. Lesson: A single tutoring session, whether conducted online or in-person.

General Conditions.

  1. Agreement: By booking a tutoring session, the Client/Student agrees to these terms and conditions.
  2. Services Provided: The Tutor will provide instruction in the agreed national curriculum subjects based on the student’s academic needs.
  3. Location: Private tutoring sessions may take place at a mutually agreed location, while online tutoring will be conducted through an approved platform (e.g., Zoom, Skype).
  4. Materials: The Tutor will provide or recommend necessary learning materials. The Client/Student is responsible for ensuring the Student has access to these materials.
  5. Duration and Schedule: Lessons will typically last 60 minutes unless otherwise agreed. The schedule will be set by mutual agreement between the Tutor and the Client/Student.

Payment Terms.

  1. Rates: Tutoring rates will be communicated before services commence. Rates may vary depending on the subject, level of study, and format (private or online).
  2. Payment: Payment must be made in advance of each lesson or as agreed upon (e.g., weekly, monthly). Accepted payment methods include bank transfer, PayPal, or other specified options.
  3. Late Payments: Failure to make timely payments may result in suspension of tutoring services until the balance is settled.
  4. Refund Policy: Refunds will not be provided for lessons already delivered. For prepaid sessions, cancellations made with proper notice (as outlined below) may be eligible for a refund or rescheduling.

Cancellation and Rescheduling.

  1. Cancellation by Student/Client: Lessons must be cancelled at least 24 hours in advance to avoid a charge. Cancellations made within 24 hours will incur a full session charge.
  2. Cancellation by Tutor: If the Tutor needs to cancel a session, they will notify the Client/Student as soon as possible. The session will be rescheduled at a mutually convenient time.
  3. Rescheduling: Rescheduling a session is possible with at least 24 hours’ notice. Less notice may incur a fee unless due to emergencies.

Responsibilities and Conduct.

  1. Tutor’s Responsibility: The Tutor will conduct lessons in a professional manner, providing clear and understandable instruction tailored to the Student’s needs.
  2. Student’s Responsibility: The Student is expected to attend lessons on time, participate actively, and complete any assignments or homework given by the Tutor.
  3. Client’s Responsibility: The Client (if applicable) is responsible for ensuring the Student is prepared for lessons and for facilitating a conducive learning environment.
  4. Code of Conduct: Respectful and appropriate behavior is expected from both the Tutor and the Student. Disruptive behavior may result in the termination of services.

Confidentiality and Privacy.

  1. Data Protection: The Tutor will keep personal information about the Client and Student confidential and comply with applicable data protection laws (e.g., GDPR).
  2. Lesson Recordings: Online lessons may be recorded with the consent of both parties for educational purposes only. Recordings will not be shared without explicit permission.

Liability.

  1. Limitation of Liability: The Tutor will not be held liable for any indirect, special, or consequential damages arising out of or in connection with the services provided. The Tutor’s total liability for direct losses will be limited to the fees paid by the Client for the services in question.
  2. No Guarantees: While the Tutor will endeavour to help the Student achieve their academic goals, the Tutor cannot guarantee specific results or improvements.

Online Tutoring Specific Terms.

  1. Technical Requirements: The Student is responsible for ensuring they have the necessary equipment (computer, internet connection, etc.) and software to participate in online tutoring sessions.
  2. Technical Issues: In the event of technical difficulties (e.g., internet outages), the session will be rescheduled at no extra cost. If the issue is on the Student’s side, the session may be rescheduled at the Tutor’s discretion.

Termination.

  1. Termination by Client/Student: The Client/Student may terminate the tutoring agreement at any time with notice. Any pre-paid sessions will be refunded, minus any applicable fees for short-notice cancellations.
  2. Termination by Tutor: The Tutor reserves the right to terminate the tutoring agreement if the Student fails to adhere to these terms and conditions or if the Tutor deems that continuing the sessions is no longer beneficial for the Student.

Disclaimers.

    1. Educational Purpose: The services provided are intended to supplement the Student’s learning and are not a substitute for formal education. The Tutor does not claim to replace classroom instruction or guarantee that the Student will pass any specific exams or attain a particular grade.
    2. Parental/Guardian Supervision: For students who are minors, it is recommended that a parent or guardian be present during private lessons and available during online sessions to ensure the Student’s safety and engagement.
    3. Content Accuracy: While every effort is made to ensure that the content taught is accurate and up to date according to the national curriculum, the Tutor is not responsible for any errors or omissions in the material provided.
    4. Third-Party Platforms: Online tutoring sessions may involve the use of third-party platforms. The Tutor is not responsible for any issues arising from the use of these platforms, including data breaches or technical difficulties.
    5. External Factors: The Tutor is not liable for any delays or disruptions in services caused by circumstances beyond their control, such as natural disasters, health emergencies, or technological failures.
    6. Health and Safety: The Tutor will take reasonable steps to ensure the safety of the Student during private tutoring sessions. However, the Tutor is not liable for any injuries or accidents that occur before, during, or after the session. For online tutoring, it is the responsibility of the Client/Student to ensure a safe and suitable environment.
    7. Changes to Terms: The Tutor reserves the right to update these terms and conditions at any time. The Client/Student will be notified of any significant changes in advance.
